1. Scope and Acceptance

These Terms govern your use of Motionometry, including account creation, listings, bookings, payments, support, and dispute workflows. By using Motionometry, you agree to these Terms.

2. Legal Framework (India)

Motionometry is designed for India-first operations. Any references to criminal conduct that were previously handled under the Indian Penal Code (IPC) are to be read with the Bharatiya Nyaya Sanhita, 2023 (BNS), in force from July 1, 2024, and other applicable Indian law.

3. Eligibility and Verification

• You must be legally competent to contract under Indian law.
• You must provide accurate identity, contact, and address information.
• We may require identity or address verification before enabling bookings, listings, withdrawals, or higher-value transactions.

4. Listings, Bookings, and Handover

• Owners must list accurate gear details, condition, serial numbers, and usage restrictions.
• Renters must use gear lawfully and return it in agreed condition and timeline.
• Both parties should create clear handover and return evidence (photos/video/checklist) to reduce disputes.

5. Payments, Deposits, and Taxes

Platform fees, deposits, and any optional protections are disclosed before confirmation. You authorize debits, credits, reversals, and charge adjustments according to booking outcomes, dispute decisions, and applicable law. Users are responsible for their own tax compliance.

6. Prohibited Conduct

You must not engage in fraud, impersonation, forged documentation, theft, intentional damage, misuse of payment instruments, abusive conduct, unlawful content, or any other illegal act. Attempted abuse of escrow, claims, or identity systems is prohibited.

7. Suspension and Termination

We may limit, suspend, or terminate accounts for legal non-compliance, policy violations, non-cooperation in investigations, or credible safety risk. We may retain records where required by law.

8. Disclaimer and Limitation

Motionometry is a platform connecting users and does not guarantee listing quality, counterparty behavior, or uninterrupted service. To the maximum extent permitted by law, Motionometry is not liable for indirect, special, incidental, or consequential loss.

9. Indemnity

You agree to indemnify Motionometry, its team, and affiliates against third-party claims, penalties, or losses arising from your unlawful acts, policy breaches, or misuse of the platform.

10. Governing Law and Disputes

These Terms are governed by Indian law. Dispute handling follows the process in Dispute Resolution. Nothing in these Terms limits rights available to consumers under mandatory law.
