Dispute Resolution

1. What Can Be Disputed

You may open a dispute for no-show, wrong item, missing accessories, delayed return, damage, theft, unauthorized charges, escrow release disagreements, or suspected fraud.

2. Internal Resolution Process

  1. Open case: Raise the dispute from your booking or via safety@motionometry.com within 48 hours of incident discovery.
  2. Submit evidence: Provide timeline, photos/videos, serial proof, chat context, payment references, and any supporting documents.
  3. Counterparty response: The other party is invited to respond and submit evidence.
  4. Trust & Safety decision: Motionometry reviews available records and may hold/release/split escrow or request more evidence.

3. Timelines

Initial response target is within 24 hours. Standard disputes are generally decided in 3 to 7 business days, depending on complexity and evidence quality.

4. Appeals

Appeals must be filed within 7 days of decision and must include material new evidence. Re-arguments without new evidence may be declined.

5. Criminal and Safety Incidents

For theft, cheating, impersonation, or other criminal conduct, parties should promptly contact local police and share complaint details with Motionometry. Criminal matters are governed by applicable Indian criminal law, including the Bharatiya Nyaya Sanhita, 2023 (which replaced IPC from July 1, 2024).

6. Mediation and Arbitration

If a dispute is not resolved internally, parties should first attempt good-faith mediation for 15 days. Failing settlement, disputes may be referred to arbitration under the Arbitration and Conciliation Act, 1996 by a sole arbitrator appointed by mutual agreement (or as per law if parties cannot agree).

7. Seat, Language, and Court Support

The seat and venue of arbitration will be Bengaluru, Karnataka, India, and proceedings will be in English unless parties agree otherwise. Either party may seek interim relief from competent courts in India.

8. Consumer Rights

Nothing in this policy limits non-waivable rights or remedies available under applicable consumer protection law.
